ChoreGami™ Terms of Service

Please read these Terms of Service carefully before using ChoreGami™ family chore management software.

⚠️ CRITICAL LEGAL NOTICE - READ BEFORE USING CHOREGAMI

BY USING CHOREGAMI™, YOU ACKNOWLEDGE AND AGREE THAT:

  • ChoreGami™ reserves the absolute right to change these Terms at any time without notice
  • ChoreGami™ cannot be sued and is not responsible for any harm caused from any use of ChoreGami™ services
  • You use ChoreGami™ entirely at your own risk and assume all liability for any consequences
  • You agree to indemnify and hold ChoreGami™ harmless from all claims and legal costs
  • ChoreGami’s liability is limited to the maximum extent permitted by law

If you do not agree to these terms, DO NOT USE the ChoreGami™ Service.

By accessing or using ChoreGami™ (“the Service”, “the Platform”), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service (“Terms”) in their entirety. If you disagree with any part of these terms, you may not access or use the Service.

These Terms apply to all users of the ChoreGami™ Platform, including family administrators, parents, and children using the family account. By creating a family account, the primary account holder represents and warrants that they have authority to bind all family members to these Terms.

2. Description of ChoreGami™ Service

ChoreGami™ is a software-as-a-service platform that enables parents to assign and track household chores, monitor completion, and manage rewards through a digital dashboard. ChoreGami™ allows families to:

  • Create and assign chores to family members
  • Track chore completion and manage points-based rewards
  • Build responsibility and life skills in children
  • Coordinate family schedules and household activities
  • Store family data securely in the cloud

The ChoreGami™ Service is provided on a subscription basis with different plan tiers offering varying features and family size limits.

3. Member Accounts and Family Requirements

3.1 Account Registration

You must register an account to access and use many features of the ChoreGami™ Platform. Registration is only permitted for legal entities, partnerships and natural persons who are 18 years or older. You represent and warrant that you are not a person or entity barred from using the ChoreGami™ Platform under the laws of the United States, your place of residence, or any other applicable jurisdiction.

You must provide accurate, current, and complete information during registration and keep your account information up-to-date. You may not transfer your account to someone else. You are responsible for maintaining the confidentiality and security of your account credentials and may not disclose your credentials to any third party.

3.2 Family Account Requirements

  • Primary account holder must be 18 years or older
  • Only one family account per household
  • Family members must be related by blood, marriage, or legal guardianship
  • Children under 13 require parental consent (COPPA compliance)

3.3 Account Security and Verification

You are responsible and liable for activities conducted through your account and must immediately notify ChoreGami™ if you suspect that your credentials have been lost, stolen, or your account is otherwise compromised.

If and as permitted by applicable law, we may, but have no obligation to (i) ask you to provide identification or other information, (ii) undertake checks designed to help verify your identity or background, (iii) screen you against third-party databases or other sources and request reports from service providers, and (iv) obtain reports from public records of criminal convictions or sex offender registrations or their local equivalents.

4. Subscription Terms and Billing

4.1 ChoreGami™ Subscription Plans

  • ChoreGami™ Monthly Plan: $5.99/month - Up to 4 family members with 1-2 parent login accounts
  • ChoreGami™ Annual Plan: $49.99/year - Up to 4 family members with 1-2 parent login accounts (save $21.89 vs monthly)
  • ChoreGami™ Large Family Monthly Plan: +$1.49/month per additional family member beyond 4 members
  • ChoreGami™ Large Family Annual Plan: +$12.49/year per additional family member beyond 4 members

Special July 2025 Offer: Monthly plans receive 2 months FREE, Annual plans receive 4 months FREE when you sign up in July or August 2025.

4.2 Billing and Payment

  • ChoreGami™ subscription fees are billed in advance on a recurring basis
  • You authorize automatic charging of your selected payment method
  • New users receive a 1-month free trial (credit card required)
  • All fees are non-refundable except as required by law

4.3 Automatic Renewal

Important: Your ChoreGami™ subscription will automatically renew for successive periods unless you cancel at least 24 hours before the renewal date. You will receive email reminders 3 days before each renewal.

4.4 Cancellation and Refunds

  • Cancel your ChoreGami™ subscription anytime through your account settings
  • Cancellation takes effect at the end of your current billing period
  • Pro-rated refunds available for annual plans within 30 days of purchase
  • EU customers have a 14-day right of withdrawal

5. Your Responsibilities and Assumption of Risk

5.1 Your Responsibilities

You are responsible and liable for your own acts and omissions and are also responsible for the acts and omissions of anyone you invite to join or provide access to your ChoreGami™ family account, including all family members added to your account. For example, this means: (i) you are responsible for ensuring all family members use the ChoreGami™ Service appropriately and in accordance with these Terms, (ii) you are responsible for monitoring your children’s use of the ChoreGami™ Platform and ensuring age-appropriate content, (iii) you must act with integrity, treat other family members with respect, and comply with applicable laws at all times, and (iv) you are responsible for all subscription fees and charges incurred through your account.

If you add family members to your ChoreGami™ account, you are required to ensure that every family member meets any requirements set by these Terms, and is made aware of and agrees to these Terms and any rules and restrictions you set within your family account. If you add a minor to your ChoreGami™ family account, you must be legally authorized to act on behalf of the minor and you are solely responsible for the supervision of that minor’s use of the ChoreGami™ Service.

5.2 Complete Assumption of Risk and Release

WARNING: By using ChoreGami, you accept all risks and release ChoreGami™ from any liability for harm or injury.

You acknowledge and expressly agree that you are voluntarily using the ChoreGami™ Service with full knowledge that household chores and family activities carry inherent and significant risks of harm, injury, property damage, emotional distress, and other adverse consequences. You assume and accept the entire risk arising out of your access to and use of the ChoreGami™ Platform and any Content, including but not limited to:

  • Physical injury or death from household tasks, cleaning activities, or use of tools and equipment
  • Property damage from chore completion or family activities
  • Emotional or psychological harm from family conflicts or disputes
  • Financial loss from subscription fees, property damage, or other costs
  • Data loss, privacy breaches, or security incidents
  • Service interruptions, technical failures, or software malfunctions
  • Any other harm or adverse consequence of any kind whatsoever

You expressly waive and release any and all claims against ChoreGami™ Parties for any harm, injury, damage, or loss arising out of or in connection with your use of the ChoreGami™ Service. This release includes claims based on negligence, breach of contract, breach of warranty, strict liability, or any other legal theory.

ChoreGami™ provides no supervision, safety oversight, or guarantee of age-appropriateness for any household tasks. You are solely responsible for evaluating the safety and suitability of all chores and activities. You freely and voluntarily assume all risks by choosing to use the ChoreGami™ Service and assign household tasks through the platform.

6. Acceptable Use Policy

6.1 Permitted Use

You may use ChoreGami™ only for personal, family organization purposes. The ChoreGami™ Service is designed for household family units and should not be used for commercial purposes.

6.2 Prohibited Activities

  • Using the ChoreGami™ Service for any unlawful purpose
  • Sharing accounts with non-family members
  • Attempting to gain unauthorized access to the ChoreGami™ Platform
  • Uploading harmful, offensive, or inappropriate content
  • Interfering with the proper functioning of the ChoreGami™ Service
  • Using the ChoreGami™ Service to harass or harm others

6.3 Content Guidelines

All content created within the ChoreGami™ Service (chore descriptions, notes, messages) must be appropriate for all family members, including children. We reserve the right to remove inappropriate content.

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Privacy Commitment: ChoreGami™ is fully compliant with GDPR, CCPA, and COPPA regulations. We never sell your data and use industry-standard security measures to protect your family’s information.

8. Intellectual Property

8.1 ChoreGami™ Service Ownership

ChoreGami™ and all related intellectual property rights are owned by us. You are granted a limited, non-exclusive, non-transferable license to use the ChoreGami™ Service for your family’s personal use.

8.2 User Content

You retain ownership of content you create in the ChoreGami™ Service. By using the Service, you grant us a license to store, process, and display your content solely for the purpose of providing the ChoreGami™ Service.

9. Disclaimer of Warranties

Important Legal Notice: Please read this section carefully as it affects your legal rights.

The ChoreGami™ Platform and all Content are provided “as is” without warranty of any kind and ChoreGami™ (or its affiliates) disclaim all warranties, whether express or implied. For example: (i) we do not endorse or warrant the performance, safety, quality, legality or suitability of any third party integrations; (ii) we do not warrant the performance or non-interruption of the ChoreGami™ Platform; and (iii) we do not warrant that verification, identity or background checks conducted on Members (if any) will identify past misconduct or prevent future misconduct.

The disclaimers in these Terms apply to the maximum extent permitted by law. If you have statutory rights or warranties ChoreGami™ (or its affiliates) cannot disclaim, the duration of any such statutorily required rights or warranties, will be limited to the maximum extent permitted by law.

10. Comprehensive Disclaimer and Complete Limitations on Liability

CRITICAL LEGAL NOTICE: This section contains important limitations on ChoreGami’s liability and your rights. Please read carefully as these provisions affect your legal rights and remedies.

10.1 Complete Disclaimer of Responsibility

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHOREGAMI, ITS AFFILIATES, SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, LICENSORS, AND SERVICE PROVIDERS (COLLECTIVELY, “CHOREGAMI PARTIES”) DISCLAIM ALL RESPONSIBILITY AND LIABILITY FOR ANY HARM, DAMAGE, INJURY, LOSS, OR ADVERSE CONSEQUENCE OF ANY KIND THAT MAY RESULT FROM OR ARISE OUT OF YOUR USE OF THE CHOREGAMI SERVICE, WHETHER DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL.

This includes, but is not limited to, any harm resulting from: (i) the assignment, completion, or supervision of household chores or tasks; (ii) family disputes or conflicts arising from use of the Service; (iii) physical injury during chore completion; (iv) emotional distress or psychological harm; (v) property damage; (vi) data loss or security breaches; (vii) service interruptions or technical failures; (viii) reliance on information provided through the Service; or (ix) any other use of or inability to use the ChoreGami™ Service.

UNDER NO CIRCUMSTANCES SHALL CHOREGAMI PARTIES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, arising out of or in connection with your use of the ChoreGami™ Service, whether based on warranty, contract, tort (including negligence), strict liability, product liability, or any other legal theory, and whether or not ChoreGami™ has been advised of the possibility of such damages.

This limitation applies to damages for: personal or bodily injury, death, emotional distress, lost profits, lost revenue, loss of data, loss of privacy, loss of goodwill, work stoppage, computer failure or malfunction, property damage, or any other pecuniary or non-pecuniary loss or damage of any kind.

10.3 Absolute Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHOREGAMI’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE CHOREGAMI SERVICE, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY, SHALL NOT EXCEED THE LESSER OF: (A) THE TOTAL AMOUNT YOU PAID TO CHOREGAMI IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR (B) ONE HUNDRED DOLLARS ($100).

This limitation applies regardless of whether the damages were foreseeable and whether ChoreGami™ was advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.

10.4 No Supervision or Safety Guarantee

ChoreGami™ is a software platform only and does not provide supervision, safety oversight, or physical monitoring of chore completion. CHOREGAMI EXPLICITLY DISCLAIMS ANY RESPONSIBILITY FOR ENSURING THE SAFETY, AGE-APPROPRIATENESS, OR PROPER SUPERVISION OF ANY HOUSEHOLD TASKS OR ACTIVITIES. Parents and guardians remain solely responsible for the safety and supervision of their children and household activities.

10.5 Fundamental Basis of Agreement

These limitations of liability and disclaimers are fundamental elements of the basis of the bargain between ChoreGami™ and you. ChoreGami™ would not be able to provide the Service on an economical basis without these limitations. These limitations will survive and apply even if any limited remedy specified in these Terms is found to have failed of its essential purpose.

11. Comprehensive Indemnification and Hold Harmless

IMPORTANT: By using ChoreGami, you agree to protect ChoreGami™ from any legal claims or costs that may arise from your use of the Service.

11.1 Complete Indemnification Obligation

You agree to defend, indemnify, and hold completely harmless ChoreGami, its affiliates, subsidiaries, parent companies, officers, directors, employees, agents, suppliers, licensors, and service providers (collectively, “ChoreGami™ Parties”) from and against any and all claims, demands, lawsuits, proceedings, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees and court costs) arising out of or in any way related to:

  • Your use or misuse of the ChoreGami™ Service in any manner
  • Your breach of these Terms of Service or any applicable law or regulation
  • Any household chores, tasks, or activities assigned, completed, or supervised through the ChoreGami™ Service
  • Any injury, harm, damage, or loss (including physical, emotional, psychological, or property damage) arising from chore completion or family activities
  • Your negligent or wrongful conduct or that of any family member using your account
  • Any disputes or conflicts within your family related to ChoreGami™ use
  • Your violation of any third-party rights, including intellectual property, privacy, or publicity rights
  • Any content you submit, post, or transmit through the ChoreGami™ Service
  • Any false, inaccurate, or misleading information you provide to ChoreGami
  • Any breach of your representations, warranties, or obligations under these Terms

11.2 Defense and Settlement

Your indemnification obligations include the duty to defend ChoreGami™ Parties with competent counsel acceptable to ChoreGami, at your expense. ChoreGami™ reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate fully with ChoreGami™ in such defense. You may not settle any claim that affects ChoreGami™ without ChoreGami’s prior written consent.

11.3 Survival of Indemnification

This indemnification obligation shall survive termination of your account, cancellation of your subscription, and expiration of these Terms. Your indemnification obligations are in addition to, and not in lieu of, any other remedies that may be available to ChoreGami™ under applicable law or these Terms.

12. Termination

12.1 Termination by You

You may terminate your ChoreGami™ account at any time by canceling your subscription and deleting your account through the Service settings.

12.2 Termination by ChoreGami

We may terminate your account if you violate these Terms, fail to pay fees, or if we discontinue the ChoreGami™ Service. We will provide 30 days’ notice when possible.

12.3 Effect of Termination

Upon termination, your access to the ChoreGami™ Service will cease, and your data will be deleted according to our data retention policy outlined in our Privacy Policy.

13. United States Governing Law and Venue

If you reside or have your place of establishment in the United States, these Terms will be interpreted in accordance with the laws of the State of Washington and the United States of America, without regard to conflict-of-law provisions. Judicial proceedings (other than small claims actions) that are excluded from the arbitration agreement in Section 14 must be brought in state or federal court in Seattle, Washington, unless we both agree to some other location. You and we both consent to venue and personal jurisdiction in Seattle, Washington.

14. Dispute Resolution

14.1 Informal Resolution

Before initiating formal proceedings, please contact us at legal@choregami.com to resolve disputes informally. We commit to responding within 30 days.

14.2 Binding Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration under the rules of JAMS (Judicial Arbitration and Mediation Services) in the state of Washington.

14.3 Class Action Waiver

You agree that disputes will be resolved individually and not as part of a class action or collective proceeding.

15. General Provisions

15.1 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

15.2 Changes to Terms

Important Notice: ChoreGami™ reserves the absolute right to modify, update, change, or replace these Terms of Service at any time and at our sole discretion.

ChoreGami™ may, at any time and in its sole discretion, modify, update, change, or replace these Terms of Service, including our Privacy Policy, with or without notice to users. Any such modification will be effective immediately upon posting to the ChoreGami™ website or Service. The terms and conditions displayed on this webpage represent the most current version and supersede all previous versions.

Your continued use of the ChoreGami™ Service following any modification of these Terms constitutes your acceptance of such modified Terms. If you do not agree to the modified Terms, your sole remedy is to discontinue your use of the ChoreGami™ Service and cancel your account.

It is your responsibility to review these Terms periodically for updates. We recommend checking these Terms each time you access the ChoreGami™ Service to ensure you are aware of the current terms governing your use.
